MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, MAY 30, 2013 AT 3PM


Present:  Dr. James Taylor, Chair, Pat LaRiviere, Vice Chair, Dr. Martin Haspel, Dr. Joanna Buffington, Beverly Knox, Jane Crowley, Susan Barker

Dr. James Taylor reminded everyone regarding this.


  • OPENING STATEMENTS
Dr. James Taylor noted the passing of Paul Lothrop on May 25, 2013.  Paul was an active member of the Eastham community and of the Board of Health.  During his time on the BOH, Paul was personally instrumental in designing 2 requirements for the benefit and welfare of the Eastham community.  We will miss him in Eastham.

Beverly Knox noted that Paul Lothrop was a man who always made her smile.  He was open, honest and you always knew where he stood.  She will miss him greatly.

Stephanie Sequin, Ryder & Wilcox, presented.

The previous plan submitted had a variance request of a 1’ reduction in the separation to groundwater and this was done to reduce the cost of the system by reducing the need for a pump chamber.  The revised plan dated May 7, 2013 removes this variance by including a pump chamber.  The revised plan includes a new variance from the Board of Health that would allow the pump change to be 48’ from the coastal bank which is a 2’ variance to the required 50’.  

Dr. Joanna Buffington made the motion to approve the plan dated March 20, 2013 and revised on May 7, 2013 with the following conditions:
  • Routine water quality test results be provided of existing well location to assure potability
  • No increase in design flow allowed.  Any increase in habitable square footage would require abutter notification and Board of Health review.
  • Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly (or 2 times per year for seasonal use) for total nitrogen, BOD, TSS, Nitrate-nitrogen not to exceed 19 mg/l.   After 2 year period of time reduction of testing could be requested to EBOH by owner.
  • Operation and maintenance agreement to be submitted to EBOH.  Operation and maintenance agreement to be required for the life of the system.  Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
  • Deed restriction for use 4 bedroom use and use Micro FAST alternative technology requirement to be recorded on deed
  • Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
  • Subject to Conservation Commission approval

  • 2013 BEACH PERMIT APPROVAL
Jane Crowley advised that the process to approve this is a requirement by state regulations.  Barnstable County Health Department tests the water at all public beaches weekly and the state pays for this testing.  The testing results are posted on the Barnstable County Health Department website and a link to that is on the Town of Eastham website.  

Eastham has 12 Saltwater Beaches and 6 Freshwater Beaches that are tested weekly on Wednesdays.  The results of the testing will be available 24 hours later on Thursday.  The form requiring BOH approval lists those beaches for everyone’s information.  Each beach will be posted to note the dates that the beach is open and the dates that it will not be monitored.

Herring Pond had been treated with Alum last year and had its first testing for the season this year yesterday.  

 
  • OTHER BUSINESS
Jane Crowley advised that Phase 2 of the landfill monitoring is done.  Results mailed included a schematic of the report and a cover sheet to explain the acronyms used in the report.  

166 wells that serve 169 homes have been tested to date.  The response rate for testing has been over 70%.  A report for Phase 2 is being completed as was done in Phase 1.  The final report for Phase 2 testing results will be forwarded to the state by June 24, 2013.  

 Jane confirmed that the EPA is willing to help us in the Phase 3 testing of 1 4 Dioxane.  Phase 3 is being determined at this time testing will begin in July.  

Dr. James Taylor reminded everyone that a special Town Meeting is scheduled for June 22, 2013 at 10AM at the Nauset Regional High School.  Whether you are for and against municipal water, please come and cast your vote.
